What is civil litigation?

Civil litigation is the legal process used to resolve disputes between individuals, businesses, or organizations. These disputes may involve contracts, unpaid debts, property issues, negligence claims, or other matters where one party is seeking compensation or another legal remedy through the courts.

Do all civil disputes go to court?

No. Many civil disputes are resolved through negotiation, mediation, or settlement before reaching trial. In many cases, resolving matters outside of court can save time, legal costs, and stress for everyone involved.

How do I know if I have a legal claim?

Every situation is different. A lawyer can review the facts, agreements, communications, and available evidence to help determine whether you may have a valid legal claim or defence under the laws of your province.

How long do I have to start a lawsuit in Western Canada?

Time limits, called limitation periods, apply to most civil claims in Alberta, British Columbia, Saskatchewan, and Manitoba. In many cases, claims must be started within two years, but the timeline can vary depending on the type of dispute.

What is a builders’ lien?

A builders’ lien is a legal claim registered against a property by a contractor, subcontractor, or supplier who has not been paid for work or materials provided on a construction project. There is a strict timeline which is significantly shorter than the limitation period for a civil claim that applies to a Builder’s Lien. Please contact our offices promptly if you believe you may have a claim under the Prompt Payment legislation.

What can you expect?

There are generally three stages to a civil litigation suit:

1. Pleadings

Initiation of a civil suit occurs when the plaintiff files a claim and serves it on the defendant. A claim must be filed within 2 years from the date of the incident.

2. Disclosure and Alternative Dispute Resolution (ADR)

Documents relevant to the case are exchanged between both parties. These documents allow both sides to examine and prepare their cases. This also gives rise to ADR; document exchange can show the strength of each side’s case and can result in mediation, arbitration, or out of court settlements negotiated between the parties lawyers which can lead to a more efficient resolution, both in time and finances.

3. Litigation

If both parties are unable to settle, the case will proceed to trial. Both sides and any witnesses will make their case before a judge, and the judge will make their judgment. A jury is not involved in these cases.
