In general, divorce cases in Western Canada begin when one of the spouses (“Plaintiff”) files a “Statement of Claim for Divorce” and serves it to the other spouse (“Defendant”). If both of you agree on all matters, including division of property, spousal support, child support, and child custody, you can avoid the court process altogether. This is known as an uncontested divorce. However, if there are major disputes, a contested divorce may ensue. This option will require litigation and is the more costly of the two alternatives.
