Uncontested vs. Contested Divorce

In general, divorce cases in Western Canada begin when one of the spouses (“Plaintiff”) files a “Statement of Claim for Divorce” and serves it to the other spouse (“Defendant”). This document outlines claims made by the spouse, including grounds for divorce, child support, spousal support, and custody details.

If both of you agree on all matters, including division of property, spousal support, child support, and child custody, you can avoid the court process altogether. This is known as an uncontested divorce. However, if there are major disputes, a contested divorce may ensue. This option will require litigation and is the more costly of the two alternatives.

Stringam advises clients on both contested and uncontested divorce. We’ll work with you on getting the most favourable resolution based on your circumstances.
